Conditions of Use

1. General provisions

1.1. These Terms of Use govern the purchasing relationship between www.sumar.ee (hereinafter “the Seller”) and the customer (hereinafter “the Purchaser”).

1.3. When making a purchase, the Purchaser declares that it is aware of and accepts these Terms and Conditions.

2. Products and prices

2.1. All products sold are described as precisely as possible.

2.2. All prices of the products are communicated to the Purchaser according to the request. Prices shall be expressed in euros (EUR) and shall include value-added tax (VAT), where applicable by law.

2.3. The Seller reserves the right to change prices at any time. The price applicable to an order shall be the price in force at the time the order is placed.

3. Placing an order

3.1. In order to place an order, the Purchaser shall complete the necessary information and choose the method of delivery and payment.

3.2. The sales contract enters into force after the amount due for the order has been received in the Seller’s bank account, unless otherwise agreed.

3.3. The Seller sends the order confirmation to the Purchaser by email.

4. Payment methods

4.1. Payment can be made through all payment methods offered on the corresponding invoice.

4.2. Payments shall be made through a secure payment solution.

5. Delivery

5.1. Goods are delivered to all countries unless otherwise indicated.

5.2. The estimated delivery time is given when the order is made.

5.3. The Seller shall not be liable for a delay in delivery if the delay is caused by circumstances beyond the Seller’s control.

6. Right of withdrawal

6.1. The consumer shall reserve the right to withdraw from the purchase contract without giving any reason within 14 calendar days of receipt of the goods.

6.2. In order to exercise the right of withdrawal, a declaration to that effect must be made by e-mail.

6.3. The Purchaser shall be liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

6.4. The refund shall be made no later than 14 days after receipt of the declaration of withdrawal or after the return of the goods in accordance with the legislation in force.

6.5. The right of withdrawal may be subject to statutory exceptions (such as custom-made products or other cases laid down by law).

7. Submission of Complaints

7.1. The Seller is liable for the lack of conformity of the goods with the contract in accordance with European Union and Estonian legislation.

7.2. If a defect occurs, the Purchaser should contact the Seller within a reasonable time, describing the defect and attaching photographs if possible.

7.3. Complaints will be answered as soon as possible and at the latest within the deadline set by law.

8. Processing of personal data

8.1. Personal data shall be processed in accordance with the rules in force on the protection of personal data (GDPR).

8.2. Personal data is used to process orders, deliver, communicate with customers and comply with legal obligations.

9. Responsibilities

9.1. The Seller shall be liable only for direct damage to the extent arising from the applicable law.

9.2. The Seller shall not be liable for damage caused by force majeure or other circumstances beyond the Seller’s control.

10. Settlement of disputes

10.1. All disputes shall be dealt with by negotiation.

10.2. If no agreement is reached, the consumer has the right to go to the competent consumer dispute resolution body or court.

10.3. Terms and conditions of use are governed by the law of the Republic of Estonia to the extent that this is without prejudice to mandatory rights under European Union consumer protection law.
